With the Coast Guard's fines for noncompliance with drug and alcohol imposing a $7,500 per day/per violation penalty on any company, employers need to ensure that their testing program is in FULL compliance with the drug and alcohol testing regulations.
The Department of Transportation (DOT) states that whether a company runs its own drug testing program, or contracts it out to a Consortium/Third Party Administrator (C/TPA), the employer is responsible for "failure to implement any aspect of the program as required" and "cannot delegate responsibility for compliance." Therefore, any company found to be enrolled in a program that only puts them in partial compliance with the Coast Guard drug testing regulations will be subject to the same $7,500 per day/per violation penalty as those not in compliance at all.
